Political comment: Property rights

Gavin StewardThe following is a summary of some of the points made by Dave Steward, Executive Director of the FW de Klerk Foundation, in a speech to the Conference on Land Ownership in South Africa on 31 May 2013

Perhaps one of the most unpalatable truths of our time is that our government is planning a multi-pronged assault on the property rights of white South Africans.

The assault includes proposals in the 2011 Green Paper on Land Reform; Tokyo Sexwale’s announcement last week regarding the “deracialisation of white suburbs”; and the recently published draft Expropriation Bill.

The Green Paper advocates ‘Agrarian Transformation’ which would result in “a rapid and fundamental change in …systems and patterns of ownership and control… of land, livestock, cropping and community.” It proposes far-reaching changes to traditional forms of land ownership including the proposition that, in future, privately owned land will be freehold with ‘limited extent’.

Minister Sexwale’s plan to “deracialise white suburbs” might erode the value of the most important asset that most South Africans own – their homes. “De-racialisation” would be achieved by “obliging” banks “to provide loans to black people to purchase property in previously exclusive white suburbs”. However, there are no longer any “exclusively white suburbs”. People – whatever their race – can buy homes anywhere they like provided they can pay the prevailing market price.

The draft Expropriation Bill gives effect to the constitutional provision that property may be expropriated in the national interest which “includes the nation’s commitment to land reform, and reforms to bring about equitable access to all South Africa’s natural resources”. However, it then adds the words “and other related reforms in order to redress the results of past racial discriminatory laws or practices“. This could conceivably be used to justify the expropriation of virtually any property owned by white South Africans which might be obliquely linked in some way or the other to “past racial discriminatory laws and practices”.

What then is the origin of this multi-pronged attack on white property rights? The answer lies in the National Democratic Revolution (NDR) – which is the guiding ideology of the ruling alliance.

The NDR’s primary goal is “the resolution of the antagonistic contradictions between the oppressed majority (blacks) and their oppressors (whites); as well as the resolution of the national grievance arising from the colonial relations.”

According to the ANC’s Strategy and Tactics documents, “a critical element of the programme for national emancipation should be the elimination of apartheid property relations. This requires: the de-racialisation of ownership and control of wealth, including land; equity and affirmative action in the provision of skills and access to positions of management…”

According to the ANC, this is a continuing struggle “which, as a matter of historical necessity, will loom ever larger as we proceed along the path of fundamental change.”

In March last year, the ANC announced that the time had at last arrived for it to proceed more vigorously with its efforts to eradicate the socio-economic legacy of apartheid.  Minister Jeff Radebe, the ANC’s Policy Chief, proclaimed that “having concluded our first transition with its focus in the main, on political democratization, we need a vision that must focus on the social and economic transformation of SA over the next 30 to 50 years”.

Radebe’s views were endorsed by President Zuma in his opening address to the ANC Policy Conference in June 2012. He said that the ANC intended “to democratise and de-racialise the ownership and control of the economy by empowering Africans and the working class in particular to play a leading role”. 

The Policy Conference reached broad agreement that “this second phase of the transition should be characterised by more radical policies and decisive action to effect thorough-going socio-economic and continued democratic transformation…” 

The ANC’s National Conference at Mangaung in December last year endorsed the central elements of the “Second Phase” approach. It proclaimed that “we are boldly entering the second phase of the transition from apartheid colonialism to a national democratic society. This phase will be characterised by decisive action to effect economic transformation and democratic consolidation, critical both to improve the quality of life of all South Africans and to promote nation-building and social cohesion.”

There can be very little doubt about the seriousness of the ANC’s commitment to the redistribution of white-owned land and property. It will proceed as quickly as the objective circumstances and developing balance of power will permit.

The ANC is preparing the ground for the Second Phase by concentrating on three basic arguments. The first arises from its version of South African history in terms of which everything that happened before 1994 was irredeemably evil. Increasing use is made of the term “apartheid colonialism” – implying that whites are transient alien interlopers.

The second leitmotif is the notion that economically and socially nothing has changed in South Africa since 1994.

The third theme is the ANC’s insistence that most of the country’s current problems – and especially the triple crisis of inequality, poverty and unemployment – can be ascribed to the legacy of the past.

Whatever the historic merit – or lack of merit – of these arguments, it would be surprising if they do not stir up some degree of racial animosity – or at the very least – reinforce perceptions of white moral inferiority and black entitlement. Inevitably they will fuel demands for restitution – particularly of land.

White South Africans should wake up to the unpleasant fact that they are the main target of the NDR. Their government has launched a multi-faceted campaign to undermine their legitimate interests and rights on the basis of their race. They are like the proverbial frogs in the pot: the water is simmering and the ANC is turning up the heat.

We should seek to engage the ANC leadership at the highest possible level in very frank debate about these issues. The really scary possibility is that the ANC actually believes its own propaganda.

Above all we should defend the Constitution, the values that it espouses and the rights it protects. We should also draw the ANC’s attention to section 9(3) of the Constitution in terms of which the state may not unfairly discriminate directly or indirectly against anyone on one or more grounds – including race.

Let us return once more to the beginning of the epistle for the holiday and high festival of holy Trinity Sunday. As a person grows in wisdom and knowledge of God he will also grow in his love, adoration and worship of the holy Trinity. If God was but one, he could not incorporate the perfect loving unity as the holy Trinity does. How could he love – if he depended on something outside of himself to receive this expression of love? Being three in one fulfills this wondrously and magnificently. Two would be too little. More than three too much. A trinity without essential unity would be imperfect just as a unity without trinity. Three equal divine beings are as unreal as three unequal and subordinated beings are. The dogma of the holy Trinity in perfect unity – one being in three persons – however is beyond doubt the essence of perfection and ultimate goal of all glory and honor. It remains a mystery and we are called by the apostle to join in the praise: Oh, the depth of the riches of the wisdom and knowledge of God!  

Praised be the Lord, my God, my light, my life, my creator, who has given to me my body and soul, my Father, who protects me from my mother’s womb, who at every moment has done much good for me.

Praised be the Lord, my God, my salvation, my life, the Father’s dearest son who gave himself for me, who has redeemed me with his precious blood, who in faith bestows on me his very self, the greatest good.

Lutheran Order of service in isiZulu/seTswana

The gospel for this Sunday is from Luke 16,19-31 (Rich man and Lazarus), the epistle from 1. John 4,16b-21 and the OT reading from Dt. 6,4-9.  Today’s posting comes with a sermon on the gospel of St. Matthew chapters 9 verses 35-38 and 10 verses 1-7 written by brother Rev. E. Mkhabela (LC Gamalakhe, KZN) in isiZulu (wz1331130602 n Tr 1) and translated as usual into seTswana (wt1331130602 n Tr 1) by my father Rev. E.A.W.Weber DD.

LÖHE ON ROMANS 11:36

All things are from God, because he has created all and everything. All is maintained through him too, because he does this despite the world’s fall into sin. All and everything is aimed and goaled towards him also as it is his holy will that all that was lost, be found and reinstated and restituted to him finally. God’s creation is maintained by the savior and preserver. It is preserved and even kept from God’s destructive wrath. In the end it is to be restored to its original status by the Spirit of his grace and goodness. Thus God the Lord is all in all really. And because he and his holy, divine actions of creation, preservation and salvation are all in all, therefore the apostle praises him and would have his glory extended for ever and ever and everywhere. St. Paul does not only speak about these three continual actions of our Lord and God however, but also refers to the triune nature of God himself. The magnification and glorification: “To him be the glory forever!” does not only refer to God’s works, but also points to his essential nature as triune God. We follow suit and praise God for what he does and who he is – now and forever.

Lord God, almighty Father, creator of heaven and earth, all that is visible and invisible. You loved us before the foundation of this world. Praise be to your holy name! Lord Jesus Christ, you glorious Son of the eternal Father! You have saved us through your most precious blood. You are worthy to take honor and glory. Lord, Holy Spirit! You are our comforter and true advocate. We thank you for sanctifying us and leading us in all truth. Holy triune God! LÖHE ON ROMANS 11:34-35

nebula“Who has known the mind of the Lord? Or who has been his counselor? Who has ever given to God, that God should repay him?” (Rom 11:34-35 NIV)

St. Paul puts three questions – each one progressing deeper into the matter. All three questions are to be answered in the negative. Nobody has known the mind of the Lord, with which he led the various nations through history. Nobody was his counselor in determining the course of history either. Finally nobody has any merit or worthiness which God needs to repay either. His unspeakable goodness and wonderful providence are totally unwarranted and unearned by us and purely given, granted and implemented out of fatherly goodness, divine mercy and unfathomable love. His judgments are entirely righteous and he deals with us people without favoritism, yet all good, beauty and help we receive so bountifully is totally undeserved and remains utterly due to grace alone – nothing but grace, love and mercy. The apostle recognizes this and in this conviction he lauds and magnifies the name of the Lord, praising him and giving thanks to him alone.

Oh God and Father in heaven! You have revealed yourself to your congregation here on earth, that they would know and recognize your  fatherly goodness and unfathomable mercy. We thank you for your holy word by which you have revealed yourself from the early days of the apostles and prophets and you have preserved these gracious revelations throughout the generations. We pray: Grant us your Holy Spirit that he will rekindle in us your true light of knowledge and understanding, that we trust and believe your goodness more and more, hold on to your gracious gospel more fervently and be comforted ever more deeply by your promises. Oh God, speak to us through your holy word in good and bad times, in joy and sorrow, in life and death. Neues aus der Diakonie: Altbischof Roth erhaelt Bundesverdienstkreuz

Melsungen, 29.5.2013 – selk – Bundespräsident Joachim Gauck hat Bischof i.R. Dr. Diethardt Roth (Melsungen) von der Selbständigen Evangelisch-Lutherischen Kirche (SELK) auf Vorschlag des Hessischen Ministerpräsidenten Volker Bouffier das Verdienstkreuz am Bande des Verdienstordens der Bundesrepublik Deutschland verliehen. Jörg-Uwe Hahn, Hessischer Minister der Justiz, für Integration und Europa und stellvertretender Ministerpräsident, wird Roth die Auszeichnung am 29. Juni in Melsungen überreichen.

Mit der Verleihung des Bundesverdienstkreuzes wird vor allem das vielfältige ehrenamtliche Engagement Roths gewürdigt. „Ich war sehr überrascht und beschämt, als ich die Nachricht von der Verleihung erhielt, denn jeder ehrenamtliche Dienst braucht ein Netzwerk von Menschen, die ihn unterstützen und fördern“, so der Geehrte. Seit 1978 engagiert sich Roth, unterbrochen durch die Jahre seines Dienstes als Bischof der SELK in Hannover, als Vorsitzender des Vereins Melsunger Jugendtreff, der mit mehreren hauptamtlichen Kräften offene Jugendarbeit in der „Haspel“ betreibt und eine wichtige integrative Funktion für Melsunger Kinder und Jugendliche wahrnimmt. Die Christusgemeinde Melsungen der SELK gehört zu den 20 Trägerinstitutionen des Hauses. Das Haus ist täglich von 13 Uhr bis um 21 Uhr geöffnet, außer am Montag. Rund 50 Jugendliche besuchen täglich die Haspel. „Dies offene Angebot ergänzt die sonstige Jugendarbeit in Melsungen.“

Ein weiterer Schwerpunkt seiner ehrenamtlichen Arbeit liegt für den Altbischof in seinem Engagement für die Diakonie. Er unterstützt seit Jahren die sozialdiakonische Arbeit in Osteuropa, seit 2006 als Vorsitzender des in der SELK beheimateten Vereins „Humanitäre Hilfe Osteuropa e.V.“. Zurzeit ist der Verein vor allem in Weißrussland und Moldawien tätig. Hilfstransporte nach dort und Unterstützung vor Ort mit Waschmaschinen, Trocknern, Ausstattung für Kinderkrankenhäuser und die Erneuerung sanitärer Anlagen in einem Heim für psychisch kranke Menschen sind einige Schwerpunkte dieser Arbeit. „Mir geht es um Bekämpfung von Armut und um Hilfe zu einem menschenwürdigen Leben in der Gesellschaft“, so Roth. Deshalb hat er sich auch durch die Kirchenleitung ehrenamtlich für 7 Jahre in den Dienst des Aufsichtsrates des Evangelischen Entwicklungsdienstes (EED), der größten evangelischen Einrichtung für Entwicklungszusammenarbeit, die mittlerweile mit Brot für die Welt im Evangelischen Werk für Diakonie und Entwicklung (Berlin) verbunden ist, rufen lassen. Dort wurde er konfrontiert mit der weltweiten Armut und den dadurch gegebenen Herausforderungen.

Im Lionsclub Melsungen mit dem Motto „we serve“ hat Roth in mehreren Funktionen, darunter zweimal als Präsident, Aufgaben zur Hilfe für Bedürftige wahrgenommen. Von 1991 bis 2006 hat er als Vorsitzender des Kuratoriums des Gubener Naëmi-Wilke-Stiftes, der größten diakonischen Einrichtung in der SELK, gewirkt und den Übergang von den Gegebenheiten der DDR in die neuen Herausforderungen begleitet; unter anderen fiel in diese Zeit der Neubau des Krankenhauses.

Hauptamtlich hat Roth 27 Jahr als Gemeindepfarrer in Melsungen in der Christusgemeinde gewirkt. Während dieser Zeit war er nebenamtlich als Superintendent und Propst tätig, leitete die Synodalkommission für Rechts- und Verfassungsfragen und war einige Jahre Mitglied der Theologischen Kommission, ehe er für 10 Jahre die SELK als Bischof von Hannover aus leitete. In dieser Zeit war er auch ehrenamtlich als Vizepräsident des Internationalen Lutherischen Rates und als Vorstandsmitglied in der Arbeitsgemeinschaft Christlicher Kirchen in Deutschland tätig. Im Ruhestand hat er für drei Jahre vertretungsweise als Diakoniedirektor Aufgaben wahrgenommen. Seit über 15 Jahren arbeitet er an der Lutherischen Theologischen Hochschule Oberursel der SELK als Dozent für Kirchenrecht. Im Ruhestand hilft er gern in Gemeinden der SELK aus.

Nebenamtlich war Roth über 25 Jahre an der Geschwister-Scholl-Schule in Melsungen im Religionsunterricht tätig. Mit Freude weist er darauf hin, dass rund 40 Pfarrer, die heute im Dienst der Landeskirche von Kurhessen-Waldeck stehen, seinen Religionsunterricht besucht haben. Die Landeskirche hat ihm für diesen Einsatz ihre zweithöchste Auszeichnung, die Martinsmedaille, verliehen.
